Understanding SCRA Protection Timelines

The Servicemembers Civil Relief Act (SCRA) provides different protections with different timelines. Understanding when each protection starts and ends is critical to maximizing your benefits and avoiding missed deadlines.

Key SCRA Deadlines You Must Know

180 Days After Service Ends

Last day to request SCRA benefits from lenders. After this deadline, creditors may deny your claims.

60 Days After Service Ends

Deadline to request reopening of default judgments entered during your service.

12 Months After Service Ends

Extended foreclosure protection period. Lenders cannot foreclose without a court order during this time.

Protection Duration by Type

  • 6% Interest Rate Cap: Entire active duty period
  • Mortgage Rate Cap: Active duty + 12 months post-service
  • Foreclosure Protection: Active duty + 12 months post-service
  • Eviction Protection: Active duty period only
  • Lease Termination: Any time during service with valid orders
  • Stay of Civil Proceedings: Active duty + 90 days post-service

What Happens If You Miss a Deadline?

Missing SCRA deadlines can be costly. If you fail to request the 6% rate cap within 180 days of leaving service, lenders can legally deny your claim. You could lose thousands in potential refunds. That's why it's crucial to file as early as possible — ideally as soon as you go on active duty.

Don't Wait Until It's Too Late

Every day you wait costs you money. File for SCRA benefits as soon as you enter active duty to maximize your savings and ensure you never miss a deadline.

Frequently Asked Questions

SCRA protections begin on your active duty start date as shown on your military orders. All protections — including the 6% interest rate cap, foreclosure protection, and lease termination rights — are effective from this date. You don't need to wait for approval or file anything with the government; the law automatically protects you.
Most SCRA protections end when you leave active duty. However, some protections extend beyond service: foreclosure protection lasts 12 months after service ends, mortgage rate caps extend for one year post-service, and you have 180 days after service to request benefits from lenders.
Missing SCRA deadlines can result in losing your right to certain protections. For example, if you don't request benefits within 180 days of leaving active duty, lenders may legally deny your claim. This could cost you thousands of dollars in lost refunds. Default judgment reopening requests must be made within 60 days of leaving service.
Yes! Reserve and National Guard members qualify for SCRA when activated under federal orders (Title 10). State activations (Title 32) may have different protections depending on your state. Protections begin when you receive orders, not when you actually report for duty.
Yes, you can request SCRA benefits at any time during your active duty service and up to 180 days after leaving active duty. Lenders must provide retroactive refunds for excess interest charged since your active duty start date. Use our Retroactive Refund Calculator to see how much you may be owed.
